Who is behind Art Mechanix?

This site is currently built, modified, troubleshot, updated, and otherwise maintained by the artist whose work you’re viewing throughout: Jammes Luckett. The website address is: https://www.artmechanix.com.

Every website feature which I use to collect any personal data (during registration, subscriptions, purchases, or comments) is for the sole purpose of delivering content, products, and services concerning my work and improving experiences through personalization.

I do not share this information with any third-party except in cases where visitors are made aware that it is necessary for fulfillment of a requested product or service.

I do not spam, phish, or use any other unethical methods to promote my work. I do, however, take measures to secure your data from unauthorized parties and reduce visitors’ exposure to third-party spam, and other unethical and harmful behavior. This includes the use of technology such as SSL certificates on my domains and captcha verification on forms.

Whenever possible, I provide means for you to view what is collected and to alter or delete any accounts you longer wish to have open. If you need clarification about any of my policies or services, data removal, or any other assistance concerning my collection or use of your data please get in touch at any time.

Please be aware that some features require certain types of data for access to be provided, to otherwise function properly, or for my own security.

I will do everything in my power to accommodate requests but there are situations in which the only realistic solution would be for you to limit or avoid use of the website altogether since some types of data collection are standard functions of most every website and cannot be customized for individuals.

What personal data Art Mechanix collects and why

Comments

When visitors leave comments on the site, Art Mechanix collects the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to a reputable comment posting service such as Gravatar or Disqus service to see if you are using it. Each of those comment form providers has their own privacy policies separate from this one. After approval of your comment, if you have provided a profile picture or avatar, it will be visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website. Instead, use formats such as JPG, GIF, or PNG.

Contact Forms

Art Mechanix often uses contact forms to allow visitors to reach me by email. At minimum, I require a full name and email address so that I know who is contacting me and can respond in a personalized manner. There are often fields such as phone number and web address but these are usually optional; provided in case the visitor feels that their request should be accompanied by such information.

This data is only seen by myself and used for the purpose of correspondence directly about the matter in which the visitor has initiated contact. It is only stored in an offline address book on my personal desktop computer if it is clear that ongoing correspondence is necessary.

Cookies

If you leave a comment on my site you may opt-in to saving your name, email address and website in cookies. These are for your convenience, so that you do not have to fill in your details again when you leave another comment. These cookies will last for one (1) year.

If you have an account and you log in to this site, Art Mecahanix will set a temporary session cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, Art Mechanix will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for one (1) year. If you select “Remember Me”, your login will persist for two (2) weeks. If you log out of your account, the login cookies will be removed immediately and then reset when you log back in (if you’ve permitted it in your browser).

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after one (1) day.

If you shop at my online store, there will be additional cookies that may allow you to leave and return to items left in a shopping cart, remember login in details, or status of downloads.

IP Addresses

Like most websites, IP addresses are logged when you visit any of my websites to use services or access materials. This is a security measure for my own sake, in the event that a visitor engages in any unlawful or dangerous behaviors, takes any severely abusive actions that are counterproductive to my rights as a human being and and artist, or brings harm to those who are simply here trying to enjoy and support this work.

In such cases, IP addresses are used to enforce disciplinary measures such as blocking from service to or, in serious cases, tracking a person down for legal action. Since it’s easy for people to change IP addresses as they move to other locations or use other devices, these are logged on an ongoing basis.

Embedded content from other websites

Pages on this site may include embedded content (e.g. videos, images, articles, content share buttons, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Art Mechanix has no direct affiliation with these service providers and no control over their privacy policies and procedures. Cookies from any such websites will be visible in your browser and can be monitored, restricted, or removed by you.

Analytics

Art Mechanix may employ the use of analytics services such as Google Analytics, from time to time, to get a sense of where visitors are located around the world and what pages/features of the website are most utilized over periods of time. This data is not specific to an individual person and is used akin to an anonymous survey or poll.

Newsletter

I use one of the best known newsletter services in the world (MailChimp) and am currently the sole person who maintains that account. I can confirm that my provider has brought its service up to compliance with the EU law. There are features that allow any newsletter subscriber to update their preferences or to unsubscribe at any time.

Emails come directly from me and are sent usually no more than once a month. I do not share my mailing list with any other parties. I also do not engage in any form of spam or phishing scams.

The information you provide at newsletter registration is used solely to deliver updates about myself and my work. In the event of a contest or random prize drawing, I will use the information for notification or to request more information for prize delivery (if applicable).

Shop

For starters, my websites are protected with SSL technology to prevent billing and shipping information entered into web forms from potentially being collected by others during transmission. This might also include preferences such as wishlists and address books.

The information visible to me is information that specifically pertains to the existence of your account, any orders you place, and the ability to deliver products and services that you order.

Sometimes, I may work with third-party suppliers or distributors (iTunes, Amazon, etc.) to deliver content but I only work with ones who I find to be reputable and who use security methods to protect users.

In these cases, it is the visitors’ choice as to whether they wish to shop directly with that third party and provide personal information. Art Mechanix has no direct affiliation with these companies and they maintain their own separate privacy and legal policies.

I also utilize reputable third-party payment processors such as Stripe and PayPal, who have privacy and security policies of their own. Whenever there is a transaction in the Art Mechanix store, credit card information is sent securely – between my secure server and the secure server of the payment processor.

With the exception the last four digits (through some payment processors), your credit card information is not viewed nor stored by myself, at any time during the transaction. Payment processors handle the credit cards with specialized technology for financial transactions. Among the options my store offers, visitors are advised to choose a payment processor that you feel the most comfortable with.

For delivery, email addresses are sometimes used to provide access to digital downloads in addition to availability in your personal account.

For physical delivery, your name and mailing address may be shared with reputable postal carriers such as the United States Postal Service, UPS, and FedEx. This is for the purpose of preparing pre-paid shipping labels as well as tracking and delivery confirmation services.

Who Art Mechanix shares your data with

Art Mechanix does not directly share any information collected with any other parties, except when necessary for fulfillment of requested products and services. These include postal carriers and drop shippers.

All other points of data collection such as payment processing and certain comment forms, are done through tools that I do not personally control. Since I tend to use well-known tools and services for these features, most visitors will recognize that they are submitting data directly to those services and subject to those businesses own separate privacy and terms of service policies.

How long Art Mechanix retains your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so that I can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. This type of information is also stored in the website’s database for the purpose of displaying comment history, as is standard on all other websites.

For users that register on our website (if any), Art Mechanix also stores the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

The exception is passwords and also credit card data. Only the user themselves can see that information in full. I can only reset passwords for the user to create a new one for themselves, privately.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data Art Mechanix holds about you, including any data you have provided to me on a more personal basis.

You can also request that I erase any personal data Art Mechanix holds about you. This does not include any data Art Mechanix may be obligated to keep for administrative, legal, or security purposes.

Please be aware that since I utilize a number of tools in order to collectively offer the features of this website, any retrieval of data is not located in one convenient file. It will require a compilation of data across multiple tools and I do not have a staff. Data retrieval cannot be performed instantly — please allot up to one (1) month [as stated in the law] for me to gather and prepare the data for you.

If you are requesting both a copy of data and changes to data, you will be given the copy of the data first so that you see full disclosure of what’s on file. From there, we will proceed with any changes or deletions that are possible.

To speed up the process, I have incorporated additional tools and am using security features that they have also installed to be able to access and provide this data on your request.

  • Free copy: The first request for a copy of processed personal data will always be provided free of charge == One free copy per calendar year.
  • Subsequent copies: Further requests for copies may be charged a fee, as is allowable under the law. This fee will be charged only if further requests are unfounded, unreasonable, excessive, or repetitive. Art Mechanix also reserves the legal right to refuse to fulfill additional requests that fall under these categories and will provide written and lawful justification for the refusal.

    If I choose to honor additional requests, Art Mechanix will charge a reasonable fee per additional request until the next calendar year begins. You will be notified upfront about any such charges with written and lawful justification for the charges. These charges may involve compensation for time spent compiling and verifying identification and data or expenses required to obtain other assistance in order to fulfill your request.
  • Electronic copies: Unless otherwise requested by the user requests for data copy will be provided in commonly used electronic forms such as PDF, CSV, or text files (plain and rich-text).

For further security for both visitors and myself, all persons requesting data files will be required to provide proof that they are, in fact, the account holder or an authorized representative. Depending on what’s being requested, this may be as simple as emailing from the same email address used on the account or it may involve supplying another form of identification to be used solely for verification and then promptly and securely erased.

When confirmation of identity is needed, please allot for additional time to process your request. Up to two (2) months for complex requests, as is allowable by law.
